Aldi has been defeated by Somerset drinks company Thatchers in a bitter legal battle over a “copycat” cloudy lemon cider.

In a landmark ruling on look-alikes, the Court of Appeal ruled that Aldi infringed on the British cider brand Thatchers' trademark.

Aldi intended to take advantage of the reputation of the trademark in order to assist it to sell the Aldi product.'

The judgment handed down this morning is the latest chapter in a lawsuit launched by Thatchers in 2022 over similarities between Aldi's Taurus Cloud Lemon Cider and its own Cloudy Lemon Cider

The Somerset-based brewer had sued the supermarket for the infringement, claiming that Aldi's Taurus brand had copied its product.

Thatchers Cider has won its trade mark infringement case against discount retailer Aldi in the Court of Appeal.

Last January the High Court in London dismissed Thatchers’ case, with Judge Melissa Clarke concluding there was a low degree of similarity between the products and no likelihood of confusion for consumers.
